Mr. Monicatti is a full time professional mediator and arbitrator with extensive experience and training in all phases of alternative dispute resolution (ADR), and has served as a neutral in thousands of tort and commercial disputes since 1978 in virtually all areas of law including without limitation: banking, business dissolutions and disputes, civil rights, computer, construction project disputes and accidents, consumer protection and lemon law, contracts, employment, environmental law, health care, insurance, mass torts, motor vehicle accidents, pollution, premises liability, probate, product liability, professional malpractice (medical, dental, legal, accounting, architectural), public housing, real estate, sexual harassment and assault, workers compensation, and other claims totaling over a billion dollars in resolved disputes. He also has served by court appointment and party selection as a mediator, arbitrator, facilitator, case evaluator, receiver, expert witness, umpire, referee, and settlement master in the multi-billion dollar Dow Corning breast implant insurance coverage litigation involving 112 defendants and in the Flint, Michigan water contamination remediation case. He is a court-approved mediator for federal courts in Michigan and Indiana as well as for state courts in Michigan. In the Martindale-Hubbell Law Directory of Attorneys in the United States, Canada, and Selected Foreign Countries, his peers have rated him AV since 1989, which is the highest ranking possible. Woodward/White, Inc. lists him as one of The Best Lawyers in America, which also is based on peer-review surveys, and named him Lawyer of the Year in 2018 for arbitration in the Troy, Michigan area and in 2011 for ADR in the Detroit, Michigan area. Presentations and Publications: Mr. Monicatti is a frequent speaker nationally and locally as well as an author on various topics concerning ADR, and has trained mediators privately as well as for court programs. He is an Adjunct Professor of Law at Western Michigan Cooley Law School teaching ADR Advocacy Skills in negotiation, mediation, and arbitration. He has guest lectured at various law schools including the University of Michigan, Michigan State University, Wayne State University, and the University of Detroit. He’s authored chapters on ADR in the reference book “Michigan Civil Procedure” and has written for Michigan Lawyers Weekly, Mediate.com, The Detroit Legal News, State Bar of Michigan (SBM) section publications, Michigan’s Institute of Continuing Legal Education, and the SBM’s Cultural Awareness Project Manual. He also has served Michigan’s Institute of Continuing Legal Education as a Mediation Advisory Board member and seminar speaker/faculty member.
